Lagoon Watersports Limited Terms and Conditions – Courses at Hove Lagoon

All bookings subject to these Terms and Conditions

By submitting your booking you represent to us that you have the authority to make the booking on behalf of your party and that you accept on behalf of your party that the booking is subject to these Terms and Conditions. A contract exists as soon as we issue our Booking Confirmation Email.

You should check the details of your confirmation carefully and promptly to ensure that it accurately reflects the booking you have requested. You should immediately inform us of any discrepancies or alterations.

Prices

All activity prices are subject to change. Full payment for any activity is required at the time of booking. Once you have made your booking and paid a fee the price will not normally be subject to any change (invoice errors or omissions excepted).

In circumstance where Lagoon Watersports decides to accept a booking with no payment for part payment then balance of the price of the activity must be paid at least 4 weeks before the activity commencement date. If the balance is not paid in time, we may cancel your booked activity and retain your deposit.

Gift Vouchers

Gift Vouchers are valid for 24 months and no refunds are offered in any circumstances.

Alterations to Bookings

Customers are able to rearrange course dates up to two times with no charge when Lagoon Watersports is given :

48 hours notice for courses under £75 per person

7 days notice for courses priced between £76 – £300 per person

14 days notice for course over £301 per person

If Lagoon Watersports is given less than the required notice period this considered to be a cancellation.

In circumstances when a customer requests more than two changes of a date, a rebooking fee of 50% of the course fee will be charged.

In circumstances where the customer is unable to choose new dates or Lagoon Watersports is unable to offer suitable alternative dates a credit will be applied to the customers account that is valid for 24 months.

Cancellation charges

Customers may cancel a course with written notification from the lead name in your group.

The following cancellation fees apply when Lagoon Watersports is given :

  • More than 4 weeks notice before course/event starts – 25% of the course price will be taken as a cancellation fee.
  • Less than 4 weeks notice before course/event starts – 100% of the course price will be taken as cancellation fee.

Course Cancellation by Lagoon Watersports

In circumstance where Lagoon Watersports cancels a course (Excluding Force Majeure) the customer may choose a new date or a full refund.

Postponement due to COVID-19

If you are required to self isolate via government guidelines you can reschedule you booking to a later date within our schedule availability. No refunds are available due to COVID-19.

Force Majeure

In circumstances out of our control we will endeavour to rebook and hold credit for any activity in the future valid for 24 months. This includes cancellation by us due to COVID-19. No refunds will be given in these circumstances.

You may wish to take out course cancellation insurance which you should be ale to find searching online or by calling Guest First on 0345 90 80 101.

Safety & circumstances beyond our control

As your safety is our first concern, a course/event may be cancelled or re-scheduled or curtailed by us in weather conditions which may in our view make the course/event dangerous or unsafe or due to circumstances beyond our control (including staff illness).

We may also cancel; postpone or re-schedule a course/event where there are not enough people booked on the activity to make it viable. In appropriate circumstances the activity / or itinerary may be altered as necessary.

As with other activity-based experiences, water sports activities contain an element of risk. It must be understood that your participation in these activities is your decision and at your risk. The activity leader and centre manager have primary responsibility for the safety of the guests and crafts at all times and his/her decision is final.

If any member of your party commits an illegal or potentially dangerous act including carrying or taking of drugs during or before an activity, is under the influence of alcohol, persistently disregards the instructions of the activity leader or centre manager, or is disruptive or exhibits difficult behaviour, the activity leader and centre manager reserve the right to terminate such persons’ participation in the activity with no responsibility to them. In such an event there will be no right to any refund and we reserve the right to make a claim for costs and losses incurred.

Photo & video usage

We frequently take photos and video of customers, both adults and under 18’s. We reserve the right to use these in our brochures, social media and in any other promotional material. If you wish to opt out please email info@lagoonwatersports.co.uk

Damage or loss

Lagoon Watersports is under no liability whatsoever in respect of loss or damage to property, however caused. Lagoon Watersports is not responsible for any repairs or replacements of equipment which may be required from damage caused during your activity or within our premises. We recommend that you take out appropriate insurance cover yourselves for such uninsured losses.

Should damage or loss to vessels, persons or equipment be caused as a result of wilful damage or gross negligence by a customers, a customer under the influence of alcohol or drugs or as a result of refusal or failure to obey instructions given by our staff, then he or she will be liable for the full amount of repair or replacement and any resulting costs. The activity leader reserves the right to terminate the course/event.

Adults will at all times be responsible for minors in their charge.

Our vessels and crew are fully insured. Our policy provides full cover for the equipment and vessels and third party liability cover for your activity leader and staff. However we cannot be held responsible for any loss or damage to any person caused other than through our negligence or breach of contract.

Complaints

It is essential you raise any issues during your activity so they can be dealt with immediately. Both company directors are also available to help ensure your experience with Lagoon Watersports is a positive one.

You should check the details of your confirmation carefully and promptly to ensure that it accurately reflects the booking you have requested. You should immediately inform us of any discrepancies or alterations. If the course/event date is less than 14 days from the date of issue of the Booking Confirmation Form, notification of any discrepancies or alterations should be made within 24 hours of that date of acceptance. In all other cases, you should notify us within 7 working days of receipt of the Booking Confirmation Form.

Prices

All course/event prices are subject to change. However, once you have made your booking and paid a course/event deposit (25% of the course/event price subject to a minimum deposit of £99 or the price of the course/event if less) against the price of your course/event the price will not normally be subject to any change (invoice errors or omissions excepted). The balance of the price of the course/event must be paid at least 4 weeks before the course/event commencement date (or paid with order if the course/event is less than 8 weeks after the booking date).

Gift Vouchers

Gift Vouchers are valid for 24 months and no refunds are offered in any circumstances.

Rescheduling your dates

RYA Courses

Due limited availability you can only reschedule up to 14 days prior to the course start date to give us time to fill your place, within 14 days and up to 48 hours it will cost £99 to reschedule. Within 48 hours you will need to rebook at full cost of the session/Course

Zero to Dayskipper and Learn to Sail packages are allowed a maximum of 2 changes to dates without penalties, this must be at least 7 days prior to the course date otherwise a penalty fee of £75 will be incurred

Boating experiences trips, Powerboat ride, Jet Ski Safaris 

Individuals booked onto boating experiences may reschedule up to 48 hours prior to the activity, within 48 hours you will loose your booking and given a 25% discount on rebooking

Cancellation charges

You may cancel with written notification from the lead name in your group.

The following cancellation fees apply :

  • More than 4 weeks before course/event – loss of deposit or 25% of course/event fee
  • Less than 4 weeks before course/event – 100% of price of course/event

Group changes in numbers

Group bookings confirm numbers 4 weeks prior to the event with the final balance. Any changes in numbers we will endeavour to accommodate, the following applies

Numbers increases up to 24 hours prior to the event will be accommodated as much as possible, priced per head

Number decreases up to 7 days prior to the event will be accommodated, but where this reduce your group size below 6 persons you will need to pay for 6 persons. Session durations might vary depending on changes to group sizes

Cancellation by Lagoon Watersports

RYA Courses

If we need to cancel due to Instructor availability, damaged equipment or engine failure or weather conditions/Sea State we will give you as much notice as possible and offer new dates to complete the course.

Boating experiences trips, Powerboat ride, Jet Ski Safaris 

If we need to cancel due to Instructor availability, damaged equipment, engine failure or weather conditions/Sea State we will do all we can to arrange another suitable date, if we cannot provide suitable availability then you will be offered a full refund

Force Majeure  – In circumstances out of our control we will endeavour to rebook and hold credit for any activity in the future with a two year expiry

Photo & video usage

We frequently take photos and video of customers, both adults and under 16’s. We reserve the right to use these in our brochures, social media and in any other promotional material. If you wish to opt out please email info@lagoonwatersports.co.uk

Complaints

At each centre we have a Duty Manager who is always available to deal with any issues arising from your activity, it is essential you raise any issues during your course/activity so they can be dealt with immediately. For the RYA courses you are also able to contact the RYA directly with any complaints. Both company directors are also available to help ensure your experience with Lagoon Watersports is a positive one.

Stag and Hen Groups at Hove Lagoon

When you make a booking with us we assign staff and equipment to deliver the booking. That means we are unable to offer that space to anyone else.

If you cancel that space we are likely to incur a loss. We will have already made commitments to staff and we may have turned away other bookings. We are unable to get insurance that covers us for this loss.

We therefore do not offer refunds for cancellations.

Our cancellation policy applies in all circumstances including no shows, illness, relocation, transport failure and bereavement.

Changes to Booking

If, after your booking has been made, you wish to change your course/event in any way, we will do what we can to reasonably accommodate such changes, but it may not always be possible.

Any request for changes to be made must be in writing signed by the Lead Name in your party. You will be liable to pay any costs and expenses that we incur in making this alteration. Should you request a major alteration to the course/event booking within 4 weeks of the commencement date (such as a change of date, significant decrease in group size) then this will be treated as a cancellation and re-booking.

Customers wishing to add to a party after the initial booking will only be able to do so if sufficient places are available. Availability should not be assumed and you should contact us to check availability first. The price of your course/event may increase or decrease to reflect the changes requested by you but please note that a reduction in numbers attending a course/event will not necessarily result in a reduction in the price of the booking.
